Verify five things before signing for a Luxe by The Charlee cabin: the certificate of tradition and freedom, whether the unit has its own registry number, the land use under the territorial plan, the operating and administration agreement, and what the developer has built versus promised.

Most buyer checklists here are written for land and houses with independent title. A branded cabin adds a second layer, the contract that governs how the unit is run, and that is where money gets lost. For the product itself, start with the full guide.

Its own registry number

A finished, legally divided unit has its own matrícula inmobiliaria, and the certificate of tradition and freedom against it shows the registered owner, mortgages, liens and encumbrances. If the number is "in process", you are buying a contractual right to a property that will exist later. That is normal in Colombian development, but protection then rests entirely on the promesa de compraventa: delivery dates, what happens if they slip, and whether your money sits in a fiduciary structure or the developer's operating account.

Ask for the parent property's registry number and pull that certificate. A construction mortgage on the mother title is routine, but the release of your unit must be written into your contract and scheduled.

Territorial plan and licence

The territorial plan determines whether a parcel allows country housing, subdivision into multiple units, or agricultural use only. Request the land use certificate for the specific parcel and compare it with what has been built. If the plan allows country housing but not subdivision, a project selling twenty individually titled cabins has a problem that becomes yours at resale. Confirm the construction licence exists, who issued it and the approved unit count. Built area beyond licensed area is slow and expensive to regularise.

The operating agreement

Get the actual contract before you sign the promesa. Establish in writing:

  • Term and exit: how many years, what notice, what penalty.
  • Revenue split: the percentage of gross or net booking revenue, before or after the operator's costs.
  • Costs on your side: cleaning, linens, utilities, platform commission, maintenance, furniture replacement, each assigned to a party.
  • Owner use: nights per year, seasons, booking lead time.
  • Reporting: monthly occupancy and revenue statements, and your right to audit.
  • Brand continuity: what happens if the operator or brand licence ends.

Short-term rentals here have historically yielded 8 to 15 percent gross a year. Gross is the operative word. Ask for historical occupancy and average nightly rate on comparable units and build your own net figure.

Administration and developer

Ask for the annual budget, the monthly fee per unit, the minutes of the last owners' assembly and the reserve fund balance. Watch for developer-subsidised fees that jump after sell-out, and for voting control: if the developer or operator holds a majority, owners cannot change the operator, fees or rules. Annual property tax of 0.3 to 1.2 percent of cadastral value is additional.

Go and look at the developer's finished projects. Ask whether funds sit in a fiduciary structure and under what conditions they are released. Check the selling company's chamber of commerce registration and that the signer's authority matches the certificate.

Costs and context

Buyer closing costs run about 2 percent of the price (notary 0.27 percent, registry 0.67 percent, beneficencia 1 percent), plus your lawyer's fee. Closing normally takes 30 to 45 days for a unit with clean title; off-plan follows the construction calendar, so the delivery clause matters more.

In Guatapé and El Peñol an apartment starts at about US$86K (typical near US$154K), a finca at about US$166K (typical about US$446K) and a lot at about US$124K (typical about US$419K). Those are unmanaged and independently titled; a branded cabin trades some independence for an operating structure and a narrower resale pool. Capital gains are 15 percent when held two years or more, and appreciation has historically run 7 to 8 percent a year, history rather than a forecast.

A divided unit has its own registry number and certificate. If not yet, you are buying a contractual right, protected only by the promesa and any fiduciary structure.

What closing costs will I pay?

About 2 percent of the price plus your lawyer's fee. Closing takes 30 to 45 days with clean registered title.

How much can I earn renting short-term?

Historically 8 to 15 percent gross a year, before the operator's share, commission, cleaning, utilities and furnishing reserve.

What ongoing costs apply?

Property tax of 0.3 to 1.2 percent of cadastral value plus the monthly administration fee. Ask what the fee will be at full occupancy without developer subsidy.

How do I check the land use?
