Key takeaways

  • Request the certificate of tradition and freedom with the property's registry number (matrícula inmobiliaria) and compare the owner's name with the person showing you the finca.
  • Your 30 to 45 day closing window starts after the heirs are registered owners.
  • It is legal and almost never what a foreign buyer wants.
  • Make the succession a condition, not a hope:
  • In Guatapé and El Peñol a finca starts at about US$166K with a typical asking price of about US$446K, against about US$263K and US$574K across Antioquia.

If the owner died and the estate was never settled, nobody on the certificate of tradition and freedom can legally sign the deed. The registered owner is a dead person. The fix is a succession proceeding (sucesión), before a notary when all heirs agree or in court when they do not, and it must finish before closing.

This is the most common reason a Guatapé or El Peñol finca sits on the market for a year with a motivated family behind it. The house is real, the price is real, and the paperwork points at someone who cannot sign.

Spotting it early

Request the certificate of tradition and freedom with the property's registry number (matrícula inmobiliaria) and compare the owner's name with the person showing you the finca. The warning signs:

  • The person showing it is "the son" or "the nephew" and the owner on the certificate is someone else.
  • The last registered transfer is decades old and the family says "it was my grandfather's".
  • The seller offers a power of attorney signed by the owner. It dies with the person who granted it.
  • The family proposes a private sale document now and "the papers later".

Ask early: is the person on the certificate alive, and will they be at the notary?

What must happen before it can be sold

A succession moves the property from the deceased into the heirs' names on the registry. Only then can they sell to you.

  • Death certificate (registro civil de defunción) plus birth and marriage records establishing who the heirs are.
  • Identify every heir: children from every relationship, the surviving spouse, and anyone in a recognised unión marital de hecho. One missed heir turns a notarial succession into a court case.
  • Inventory and appraisal of the estate, including debts. Unpaid property tax rides along with the property.
  • Settle estate taxes and obligations.
  • A notarial deed of partition (escritura de partición) if all heirs are of age, present and in agreement; a court proceeding if there is a minor, an absent heir or a dispute.
  • Register the partition deed at the Oficina de Registro de Instrumentos Públicos.
  • Only now, the sale deed to you.

Your 30 to 45 day closing window starts after the heirs are registered owners. A clean notarial succession takes weeks to a few months; a contested one, or one with an heir abroad, runs far longer, with no end date at the start.

Buying derechos herenciales

It is legal and almost never what a foreign buyer wants. You buy a share of an unsettled estate, not a specific property, and inherit the family's timeline and disagreements. One holdout heir stops you forcing the sale on your own schedule. It suits a buyer with a lawyer, local patience and a discount large enough to pay for both.

The promesa

Make the succession a condition, not a hope:

  • The sale is conditional on the partition deed being registered and the certificate showing the selling heirs as owners, free of liens.
  • Every heir signs the promesa. A promesa signed by one of four heirs binds one quarter of a problem.
  • A hard outside date, after which you walk and your money comes back.
  • The deposit held in escrow or with the notary, not by the family.
  • Who pays the succession costs and the estate's unpaid property tax (0.3 to 1.2 percent of cadastral value a year; several years of arrears is real money).

Also confirm the surviving spouse's position in writing: a spouse often holds both an inheritance share and a separate conjugal share, two rights to resolve.

The wait and the price

In Guatapé and El Peñol a finca starts at about US$166K with a typical asking price of about US$446K, against about US$263K and US$574K across Antioquia. The family's need to divide proceeds is what makes the price negotiable.

While you wait, verify land use. The territorial plan decides whether the parcel allows country housing, subdivision, or agricultural use only, and inherited rural land is often agricultural only. No succession fixes that. Budget buyer closing costs of about 2 percent (notary 0.27 percent, registry 0.67 percent, beneficencia 1 percent) plus your lawyer, whose fee you should not trim here. See the legal guide buying property colombia for the standard checks.

Never send money until the certificate shows a living owner who will be at the notary, or the heirs already registered after a completed partition.

Frequently asked questions

How do I check the seller is the registered owner?

Request the certificate of tradition and freedom with the registry number and compare the owner's name with the person proposing to sign. If they do not match without documents, stop.

Can the deceased owner's power of attorney still be used?

No. A power of attorney ends when the grantor dies, however recently it was notarised.

Does a succession have to go to court?

Only if there is a minor heir, an absent heir or a dispute. A notary can handle it when every heir is of age, present and in agreement.

How long will closing take?

The 30 to 45 day window starts once the partition is registered. The succession runs before that.

What happens to unpaid property tax?

It stays with the property. Require proof of payment before the deed or deduct it from the price.
