A signed escritura that was never registered at the Oficina de Registro de Instrumentos Públicos does not make you the owner. In Colombia, title transfers on registration, not on signature. Until the new escritura appears on the certificate of tradition and freedom, the seller remains the registered owner and the property is exposed to their creditors.

The legal guide buying property colombia covers the documents. This page covers the gap between the notary and the registry, usually a few days, occasionally months.

Why the escritura is not enough

Colombian law splits the transfer in two. The escritura pública is the title: the deed signed before a notary. Registration is the mode: the act that moves ownership in the public record. Signing creates an obligation; registering creates the right. In between you hold a contractual claim against the seller. You can sue them, but you cannot stop a third party who registers first.

The test is simple. Pull a fresh certificate of tradition and freedom using the matrícula inmobiliaria. If your name is not in the last anotación, the transfer has not happened.

What can go wrong

  • An embargo lands first. A creditor of the seller registers an attachment before your deed arrives. The registry processes entries in order of presentation, so your deed enters behind a lien you did not negotiate.
  • The seller sells twice. Rare, but the law favours whoever registered first.
  • The registry rejects the deed. The common one, and not fraud: a missing property tax paz y salvo, an area mismatch, unpaid valorización, a cadastral number that does not line up.
  • The seller dies or is declared incapable. The property becomes part of an estate.

Timing and who follows it

Closing normally takes 30 to 45 days once the deal is agreed, with registration at the end. Registry rights are the 0.67 percent line in your closing costs, about 2 percent of the price in total (notary 0.27 percent, registry 0.67 percent, beneficencia 1 percent), plus your lawyer's fee.

In many transactions no one is contractually responsible for confirming the deed came back registered. The notary's job ends at signing. Put it in your lawyer's engagement: the file closes when the certificate shows you as registered owner, and the lawyer delivers that certificate, not the escritura.

Between signing and registration

  • Get a certificate dated the morning of the signing. Liens can register in days.
  • Hold back part of the price until the registered certificate shows your name.
  • Present the deed the same week, and keep the turno, the registry's receipt number and date, which fixes your place in the queue.
  • Pull a fresh certificate two to four weeks after presentation and confirm no other anotación slipped in ahead of yours.
  • Read the new certificate line by line: your name, passport or cédula number, registry number and area. Errors are cheapest to fix early.

Fincas, lots and apartments

The mechanism is identical; the risk is not. Rural files are where mismatches cluster: hand-measured areas, informal family splits, linderos described by a neighbour's fence. Land use is also set by each municipality's territorial plan, and a deed assuming a subdivision the plan does not permit creates a second problem. In Guatapé and El Peñol a lot starts at about US$128,000 (typical near US$431,000) and a finca at about US$171,000 (typical near US$460,000). An apartment in a titled building starts at about US$89,000, with a short, clean registry history.

Discovering it years later

If the seller is alive and cooperative, present the original escritura, fix what the registry objects to, and settle tax arrears. Annual property tax runs 0.3 to 1.2 percent of cadastral value, and years of unpaid predial must be cleared first. If the seller has died, vanished, mortgaged or sold the property, you are in court enforcing a contract, and the person in the registry has the stronger position. Your holding period for the 15 percent capital gains rate (two years or more) also runs from registration.

Celebrate when the certificate comes back with your name in the last anotación, not at the notary.

Frequently asked questions

Am I the legal owner once I sign the escritura?

No. Ownership transfers only on registration. Until your name is in the last anotación, the seller remains the registered owner.

How do I check that my purchase was registered?

Request a certificate of tradition and freedom with the matrícula inmobiliaria. If the latest entry names you, the transfer is complete.

What if a creditor registers an embargo before my deed?

Entries are recorded in order of presentation, so your deed enters behind the embargo and you own the property subject to the lien.

How long does registration take and what does it cost?

It sits at the end of the 30 to 45 day closing. Registry rights are 0.67 percent of the price, within total buyer costs of about 2 percent.

Can I hold back part of the price?

Yes, and it is standard. Release it only once the certificate shows you as registered owner.
