Key takeaways

  • Colombian marriage creates a sociedad conyugal, a shared economic estate.
  • Compare the acquisition date with the marriage date.
  • A widowed seller is different: the estate passes through sucesión, and the heirs control the transfer.
  • The non-signing spouse can bring an action to have the transfer declared ineffective as to their share, and the dispute is annotated on the registry folio.
  • Closing normally takes 30 to 45 days once the deal is agreed, and the civil status check fits inside it if you start on day one.

The spouse usually has to sign. If the registered owner is married or in a recognized unión marital de hecho, a Colombian notary will normally require the spouse or partner to appear and sign the escritura too, even when only one name is on the certificate of tradition and freedom. A sale without them can later be attacked.

This is the most common reason a closing that looked clean stalls at the notary's desk, and the standard legal guide buying property colombia checklist tends to treat it as a footnote. In Guatapé, El Peñol and Oriente Antioqueño, where much inventory is family land held for decades, it comes up constantly.

Why a spouse off the title still signs

Colombian marriage creates a sociedad conyugal, a shared economic estate. Unless the couple signed capitulaciones (a prenuptial agreement) or liquidated the sociedad, anything acquired during the marriage belongs to it, whoever's name is on the deed. The registry shows one owner; the law recognizes two interests.

The same logic reaches unmarried couples: a unión marital de hecho that has lasted long enough, or been declared before a notary or judge, creates a sociedad patrimonial with the same effect. Notaries in small municipalities know the families, and that is often how it surfaces: the seller's stated civil status does not match what they told you.

Documents to request before the promesa

  • Registro civil de nacimiento of the seller, recently issued. Its margin notes record marriage, divorce and death, and tell you the real civil status.
  • Registro civil de matrimonio, with margin notes, if married. A divorce means nothing until annotated here, and the sociedad is only extinguished once liquidated.
  • Certificate of tradition and freedom, requested with the matrícula inmobiliaria. It shows the owner, mortgages, liens and encumbrances, and the acquisition deed with its date.

Compare the acquisition date with the marriage date. If the property came after the marriage, assume the spouse must sign until a lawyer proves otherwise.

  • Both sign the escritura. The simplest route.
  • A notarized power of attorney (poder) that identifies the property by registry number. A vague general poder is a problem, not a solution.
  • Capitulaciones matrimoniales registered before the marriage, excluding the property. You want the deed itself.
  • A liquidated sociedad conyugal, by public deed or court ruling, annotated on the civil registry, with the adjudication appearing in the chain on the certificate.

A widowed seller is different: the estate passes through sucesión, and the heirs control the transfer.

If you close anyway

The non-signing spouse can bring an action to have the transfer declared ineffective as to their share, and the dispute is annotated on the registry folio. Your title becomes unsellable and unmortgageable while it runs. Title insurance is not a normal part of Colombian closings, so the protection is procedural: verify first, sign second.

Timing and cost

Closing normally takes 30 to 45 days once the deal is agreed, and the civil status check fits inside it if you start on day one. What blows the timetable is discovering the issue at the notary in week five. The promesa de compraventa should name every person who must appear, state each one's civil status, and make spousal consent an express condition, with the deposit refundable if it is not delivered.

The check does not change buyer closing costs: about 2 percent of the price (notary 0.27 percent, registry 0.67 percent, beneficencia 1 percent), plus your lawyer's fee. For scale, in Guatapé and El Peñol a finca starts at about US$168,000 (typical near US$451,000), a country house at about US$183,000 (typical around US$328,000) and a lot at about US$125,000 (typical near US$423,000).

Where it bites hardest

It bites hardest on rural land. Fincas and lots around Guatapé, El Peñol, Marinilla and Guarne are often held by one spouse on paper, acquired thirty or forty years ago, sometimes after a separation never formalized. The seller sincerely believes the property is his alone. The second pattern is inherited land where a parent died, the surviving spouse stayed, and no sucesión was opened. Both surface through the registro civil margin notes.

Frequently asked questions

Does a spouse have to sign if they are not on the title?

Usually yes, because property acquired during the marriage forms part of the shared estate. Exceptions are registered capitulaciones or a formally liquidated sociedad conyugal.

How do I check a seller's real civil status?

Request a recent registro civil de nacimiento and read the margin notes, plus the registro civil de matrimonio if married. Do not rely on what the seller says.

What if the spouse objects after I buy?

They can challenge the transfer as to their share, and the dispute is annotated on the registry folio, making the property effectively unsellable while it runs.

Does an unmarried partner have rights?

They can. A declared or long-lasting unión marital de hecho creates a sociedad patrimonial with similar effects to marriage.

How much time does spousal consent add?

Little, if you start on day one. Fresh civil registry copies or a poder take days.
